CarePickup Terms & Conditions

These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", or "your") and Enrich Arcane (Pvt) Ltd, doing business as CarePickup ("CarePickup", "we", "us", or "our"), governing your access to and use of the https://carepickup.us website, the CarePickup Parent App, the CarePickup Driver App, and all associated software, APIs, and services (collectively, the "Platform").

By downloading, installing, accessing, or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our companion Privacy Policy. If you do not agree with any part of these Terms, you must immediately discontinue use and uninstall all CarePickup mobile applications.

CarePickup is a specialized technology platform designed to streamline, coordinate, and safeguard the daily transportation of children between homes, primary schools, and daycare centers. The Platform provides:

• Student Manifest Management: Digital passenger manifests generated dynamically for each school pickup run based on parent authorizations and daily schedules.
• Live Telemetry & Safety Tracking: High-frequency GPS location broadcasting from authorized driver vehicles during active trips, coupled with our proprietary Privacy Guard technology that shields individual student itineraries.
• Automated Handover Verification: Digital timestamps for student boarding (PICKED_UP), departures, drop-offs (DROPPED_OFF), and route exceptions (e.g., student absent or sick).
• Real-Time Parent Alerts: Push notifications and in-app communications regarding vehicle departure, 5-minute approach warnings, safe arrival confirmations, and unexpected route delays.

Please Note: CarePickup provides software and telemetry solutions. Unless explicitly stated in a separate written agreement, CarePickup is not a direct transportation carrier; physical transportation is conducted by the licensed daycare centers, schools, or contracted fleet operators who license the Platform.

To maintain safety, access to the Platform is restricted to verified individuals under three distinct user roles:

You agree to provide true, accurate, current, and complete information during registration and to maintain password confidentiality. You are solely responsible for all activities occurring under your account credentials. You must notify us immediately at support@carepickup.us if you suspect unauthorized access.

As a parent or legal guardian registering children on the Platform, you represent, warrant, and agree to the following obligations:

• Legal Guardianship: You are the parent or court-appointed legal guardian possessing full legal authority to enroll each child and authorize their school transit.
• Accurate Emergency & Medical Disclosures: You agree to provide accurate emergency contact telephone numbers and immediately disclose any medical conditions, life-threatening allergies (e.g. peanut allergies, EpiPen needs), or special physical requirements that transit staff must know.
• Punctuality at Handover Points: You or an authorized adult must be present at the designated residential or gate pickup/drop-off point at the estimated arrival time. Drivers cannot abandon routes or other children to wait indefinitely.
• Authorized Drop-off Persons: You must promptly update daycare staff and your profile if an individual other than yourself is designated to receive your child at drop-off.

Authorized drivers and transport escorts agree to strictly uphold the following standards:

• Valid Licensing & Fitness: Maintain a valid commercial passenger driving license and all state or local transit certifications required by law.
• Zero Substance Tolerance: Absolute zero tolerance for alcohol, narcotics, or medications impairing motor reflexes prior to or during any transit shift.
• Consent to Shift Telemetry: Unconditional consent to the broadcast of real-time GPS location coordinates and speed telemetry while on an active assigned route.
• Safe Handover Protocol: The driver must visually verify every child boarding or exiting the vehicle and record timestamps in the app. Drivers must never leave a child unattended inside a vehicle under any circumstance.
• No Unauthorized Passengers: No unauthorized person or pet may be transported in the vehicle during active student transit routes.

Daycare centers, preschools, and private transport fleet operators utilizing CarePickup are responsible for:

• Conducting comprehensive criminal background checks and drug screenings on all drivers and vehicle escorts.
• Maintaining full motor vehicle liability, passenger liability, and institutional child safety insurance.
• Verifying that all assigned transport vehicles meet local vehicle safety inspection criteria, tire standards, and seatbelt regulations.
• Reviewing and validating new parent and child profile registrations prior to approving them for transit.

CarePickup employs sophisticated GPS mapping and algorithmic ETA estimation to deliver live transit updates. However, users acknowledge and accept that:

• External Variable Limitations: Estimated arrival times (ETAs) are calculated based on current traffic flow, weather, and distance. Sudden traffic congestion, road construction, school gate congestion, police diversions, or inclement weather can cause unavoidable delays.
• GPS & Cellular Connectivity: Cellular dead zones, satellite multipath reflection, or subterranean parking structures may occasionally cause temporary delays in telemetry broadcast. The Driver App stores unsynced pings in an offline queue and auto-syncs immediately upon network reconnection.
• Not an Emergency Dispatch Service: CarePickup is a transit coordination tool and does not replace emergency 911 or first-responder services. In the event of a life-threatening emergency, call local emergency services immediately.

The CarePickup Parent App provides a single-tap Daily Pickup Toggle (POST /parent/pickup-requests/toggle) allowing parents to alternate between daycare van collection and personal drop-off:

• Cut-Off Times: To prevent empty van diversions, daily pickup toggles should be completed prior to the daily route dispatch cut-off time established by your daycare center (typically 30 to 60 minutes before morning or afternoon dispatch).
• Automated Route Manifest Pruning: If you toggle your child OFF for today's van run, your child's entry is immediately removed from the driver's active route waypoints, optimizing the transit time for all other families.
• Absence Communication: If your child is sick or absent from school, toggling them off in the app prevents drivers from needlessly stopping at the school gate or causing route delays.

You agree that you will not engage in any of the following prohibited behaviors:

• GPS Telemetry Spoofing: Utilizing mock location software, VPN tampering, or simulated telemetry to falsify vehicle coordinates or child handover locations.
• Reverse Engineering: Decompiling, reverse engineering, scraping, or attempting to extract the source code or proprietary algorithms of the Platform.
• Unauthorized Surveillance: Attempting to bypass the Privacy Guard to locate or track children or families other than your own.
• Harassment & Abuse: Threatening, harassing, or abusing drivers, daycare staff, or customer support representatives through the app or during transit handovers.
• Account Sharing: Lending, selling, or sharing account access credentials with unvetted third parties.

All software, user interfaces, logos, brand names, visual designs, database schemas, and documentation related to CarePickup are the exclusive intellectual property of Enrich Arcane (Pvt) Ltd. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for its intended child transit management purpose.

We reserve the right to suspend or terminate your account and access to the Platform immediately, without prior notice, in the event of:

• Material violation of these Terms or our Privacy Policy.
• Endangerment of child safety, verbal abuse, or physical harassment of transit staff or drivers.
• Fraudulent account details or submission of false emergency information.
• Termination of your enrollment contract by your participating daycare center or school.

You may terminate your account at any time by following the account deletion process outlined in Section 11 of our Privacy Policy.

THE PLATFORM AND ALL ASSOCIATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR UNINTERRUPTED ERROR-FREE OPERATION.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CAREPICKUP, ENRICH ARCANE (PVT) LTD, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

• Traffic delays, mechanical vehicle breakdowns, severe weather, or force majeure events affecting transit times.
• Actions, omissions, vehicular accidents, or negligence of third-party vehicle drivers, daycare centers, or transport operators.
• Temporary cellular network outages, GPS satellite drift, or device hardware malfunctions.

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka, without giving effect to any principles of conflicts of law. Any dispute, controversy, or claim arising out of or relating to this contract, including its formation or breach, shall first be submitted to good-faith conciliation between the parties, and if unresolved, to the competent courts of jurisdiction.
